Tamarius Blair Davis, 27, was sentenced Thursday, Oct. 29, to 50 years in prison for the murder of 21-year-old Dustin Wakefield on Miami Beach, Florida. The killing took place on Aug. 24, 2021, when Wakefield tried to protect his 1-year-old son from an armed attacker.
Under the sentence, Davis will spend 50 years in a Florida state prison, with a mandatory minimum of 25 years. He will also serve 20 years of probation after his release. He received additional sentences on the remaining charges, which will run concurrently. Prosecutors had sought a life sentence, while the defense asked that the punishment be limited to the mandatory minimum of 25 years.
According to police and prosecutors, Davis, who had come to Florida from Georgia, took hallucinogenic mushrooms before approaching the Wakefield family, who were sitting outside the Mexican restaurant La Cerveceria de Barrio at 1412 Ocean Drive. He allegedly pointed a gun at the 1-year-old child, prompting the boy’s father to intervene. Prosecutor Casey Hughes said the attacker first shot Wakefield in the leg, then laughed and danced before firing four more shots at him. The 21-year-old died in front of his family.
During the hearing, Davis’ defense attorney, Juan Mourin, argued that his client was in a state of “psychosis induced by taking a large amount of psychedelic substances.” According to the defense, Davis lost touch with reality and was convinced that he was “taking part in a video game.” The attorney also stressed that Davis was 22 at the time of the killing and had not previously shown similar behavior.
Prosecutors rejected those arguments, pointing to the course of the attack and calling for a life sentence.
Judge Stuzin acknowledged that Davis was under the influence of marijuana and psychedelic substances, but said this did not sufficiently explain his behavior.
Before the sentence was announced, the defendant pleaded guilty.
